Legislative approaches to environmental protection in offshore decommissioning projects

Abstract

Historical evidence demonstrates that severe industrial accidents involving the release of hazardous substances into the environment significantly strengthen legislation through the implementation of more stringent provisions. In addition to the impacts on companies and society at large, concepts such as Process Safety Management, are adopted, whose systematic approach focuses on identifying, evaluating, and controlling industrial risks associated with operational processes. This article examines the establishment of laws, standards, and decommissioning regulations for the offshore oil and gas industry, analyzing the extent to which some of these frameworks utilize a risk-based approach in their definitions. The bibliographic research employed a systematic literature review to delineate the legal framework for offshore decommissioning, comparing five countries. The results confirm the growing need for an interdisciplinary and systemic approach in decommissioning projects, integrating them with sustainable development objectives. The conclusion indicates that, although there are countries with robust decommissioning legislation and plans, Brazil will need to go beyond global benchmarks.
