Water degradation in Brazil necessitates the application of environmental civil liability to internalize costs and influence behaviors, transforming development into a 'risk society' where pollution affects everyone. The study analyzes the legal foundations and challenges of environmental civil liability in Brazil, focusing on the protection of water resources. The methodology is based on a bibliographic review of legal documents, scientific articles, and pertinent jurisprudence. It highlights that civil liability is objective, joint and several, and unlimited, governed by the polluter-pays principle and the theory of integral risk. It emphasizes that the legal regime seeks the reparation and prevention of future risks, despite the challenges in proving diffuse damages. It concludes that the Brazilian legal framework is robust but requires continuous improvement to face new threats and guarantee water sustainability for future generations.Downloads
